1. SCOPE OF APPLICATION
1.1. These General Terms and Conditions (hereinafter referred to as “GTC”) govern the contractual relationship between MobileProxyNow, represented by Niels van Veen, c/o Postflex #8764, Emsdettener Str. 10, 48268 Greven, Germany (hereinafter referred to as “MobileProxyNow”), and its contractual partners in the form of end customers (hereinafter referred to as “Users”). These GTC apply in their current version at the time of contract conclusion. MobileProxyNow operates its own mobile proxy infrastructure and additionally resells proxy services obtained from verified third-party providers located in Germany, the United Kingdom, the United States, and other regions. MobileProxyNow acts as a digital service provider and not as a telecommunications carrier. Separate Terms and Conditions apply to authorized resellers and can be accessed at https://mobileproxynow.com/terms-resellers.
1.2. Any conflicting or deviating terms of the User shall not apply, even if MobileProxyNow has not expressly objected to them. Deviations from these GTC are valid only if they have been expressly confirmed in writing by MobileProxyNow.
1.3. If the parties agree on provisions that deviate from these GTC, such individual agreements shall take precedence over the respective clauses of these GTC. Any such deviations must be made in text form to be valid.
1.4. MobileProxyNow reserves the right to amend these GTC, even for ongoing contractual relationships, if such changes become necessary due to legal adjustments, court rulings, or relevant market developments. Users will be informed of planned amendments by email, with the modified sections clearly highlighted. Users have the right to object to the proposed changes within 14 days of receiving the notification. If no objection is made within this period, the amended GTC shall be deemed accepted. This consequence will be expressly stated in the corresponding email. If a User objects, MobileProxyNow is entitled to terminate the contract for good cause.
1.5. These GTC apply in their respective version at the time the contract is concluded. For questions regarding these Terms or the provided services, users can contact support@mobileproxynow.com.
1.6. Users are responsible for ensuring that their use of the services complies with all applicable laws and regulations in their respective country. They must not use the services in violation of export control laws, sanctions, or other legal restrictions.
1.7. The contractual language is English. All agreements, notifications, and communications related to these Terms are made in English unless expressly agreed otherwise in writing.
2. SUBJECT OF THE CONTRACT
2.1. MobileProxyNow is a provider of mobile data switching services in the form of so-called proxy services against payment. It operates its own mobile proxy infrastructure and additionally resells proxy resources obtained from verified third-party providers located in Germany, the United Kingdom, the United States, and other regions. Resellers receive quotas for the use of MobileProxyNow’s proxy services (hereinafter referred to as the “Service”) to resell them to end customers. This allows end customers to connect to the Internet via a dedicated mobile proxy server. The functional scope of the Service is detailed in the current service description available at https://mobileproxynow.com.
2.2. MobileProxyNow provides commercial users and authorized resellers with access to mobile proxy connections (“Service”) through a secure online dashboard. After conclusion of the contract and payment of the corresponding usage fee, users and resellers gain access to the system, which enables them to purchase, renew, configure, and manage their proxies. The dashboard includes functions such as IP rotation, credential management, whitelisting, fingerprint settings, traffic overview, and other automation or monitoring tools. The functional scope and available features of the Service correspond to the options visible within the user dashboard.
2.3. Each user must create an individual account to access and use the dashboard. Guest purchases or anonymous access are not permitted. Account creation is mandatory to ensure proper identification, security, and management of purchased proxy services. Users are required to provide accurate and complete information during registration and must keep their credentials secure. Any unauthorized access or misuse of an account must be reported immediately to support@mobileproxynow.com.
2.4. MobileProxyNow provides the Service “as is” and does not guarantee specific quality, availability, or legality of the Service. Users and resellers are responsible for ensuring that their use of the Service complies with all applicable laws and regulations. MobileProxyNow is not liable for any disputes, losses, or damages arising from the use of the Service by users, resellers, or their end customers.
2.5. MobileProxyNow may modify, limit, extend, or discontinue parts of the Service at any time if required for maintenance, technical upgrades, network optimization, or security reasons. Scheduled maintenance work that results in temporary interruptions will, whenever possible, be performed during low-traffic hours and communicated in advance through the dashboard or email. MobileProxyNow takes reasonable technical and organizational measures to ensure stable operation but does not guarantee uninterrupted service. Temporary downtimes caused by third-party network operators, mobile carriers, or upstream infrastructure providers are beyond MobileProxyNow’s control and do not constitute a service defect.
3. CONCLUSION OF CONTRACT
3.1. The conclusion of the contract takes place through the MobileProxyNow dashboard after the user or reseller has logged in to their account. All purchases of proxy services are carried out within the dashboard environment. The general presentation of plans or prices on https://mobileproxynow.com serves for informational purposes only and does not constitute a legally binding offer.
3.2. Within the dashboard, users can top up their account balance under the section “Add Funds.” The user can choose between payment by credit card (via Stripe) or cryptocurrency (via Cryptomus). Once the payment has been successfully processed, the credited amount becomes immediately available as internal account balance and can be used to purchase proxy services provided by MobileProxyNow.
3.3. In exceptional cases, MobileProxyNow may provide a Cryptomus payment link directly to the customer upon request. The payment is then processed outside the dashboard; however, by completing the payment, the customer explicitly agrees to these General Terms and Conditions and acknowledges that the credited amount is treated as a non-refundable account top-up available for purchasing proxy services within their dashboard balance.
3.4. Top-ups serve exclusively to purchase services provided by MobileProxyNow and cannot be withdrawn, refunded, or transferred to another account once credited. When a user purchases a proxy plan using their available balance, this constitutes a legally binding offer to conclude a service contract. A binding contract is formed when MobileProxyNow activates the ordered proxy service and makes access data available through the dashboard.
3.5. All top-ups and service purchases are automatically recorded and visible under the “Billing” section of the dashboard. Each entry includes payment details and activation confirmation, which the customer can view or download at any time. A binding service contract is considered concluded once MobileProxyNow has credited the payment and activated the ordered proxy service.
3.6. MobileProxyNow stores all essential contract and payment information within the customer’s dashboard account. This includes top-ups, active proxy plans, renewal history, and invoices, which remain accessible at any time under the “Billing” section. Customers can download or print these records for their own documentation. The stored data serves as the official confirmation of the concluded contract and the provided service.
3.7. Customers and resellers must provide complete and accurate information when registering and placing orders within the MobileProxyNow dashboard. This obligation also applies to any subsequent changes to account, billing, or company data. MobileProxyNow reserves the right to verify the provided information and to reject or suspend orders, top-ups, or account access if there are reasonable doubts about the accuracy, legality, or authenticity of the information supplied.
4. CUSTOMER ACCOUNT, REGISTRATION
4.1. Each customer must create an account before purchasing or using any services. Guest orders without registration are not permitted. Account creation is mandatory to ensure secure access to the dashboard, proper identification of the customer, and correct allocation of top-ups and purchased proxy services.
4.2. Registration is free of charge. There is no entitlement to registration. MobileProxyNow reserves the right to make registration subject to additional verification requirements, such as identity or data validation, to prevent misuse. Customers are required to provide complete and accurate information during registration and must immediately update their data if any changes occur.
4.3. The personal data provided during registration are stored by MobileProxyNow so that the customer can log in to the dashboard at any time using their access credentials. This data is processed and stored solely for the purpose of account management, payment allocation, and service provision, in accordance with the applicable data-protection laws, including the EU GDPR.
4.4. Customers must keep their login credentials, including passwords, strictly confidential and ensure that they are not accessible to unauthorized third parties. Passwords must be secure, consisting of at least eight characters and including uppercase and lowercase letters, numbers, and special characters. The customer is responsible for all activities carried out through their account and must ensure that the dashboard is used only by authorized persons.
4.5. Customers must inform MobileProxyNow immediately of any unauthorized use of their account or other security breaches. MobileProxyNow is not liable for damages resulting from unauthorized access or misuse of the account unless such incidents are caused by the company’s own fault or negligence.
4.6. Customers can delete their account at any time through the dashboard or by contacting MobileProxyNow support. When an account is deleted, all personal data that are not subject to statutory retention obligations will be permanently erased. If statutory retention periods apply (for example, accounting or transaction data), such data will be archived securely and automatically deleted after the legal retention period expires.
4.7. By subscribing to the newsletter, customers agree to receive occasional information about new products, system updates, or service improvements via email. Customers may unsubscribe at any time using the link contained in each email or by contacting support@mobileproxynow.com.
4.8. If a customer has already made a purchase and provided an email address, MobileProxyNow may use this address to send information about similar or related services. The customer may object to this use at any time by clicking the unsubscribe link in the email or by contacting support@mobileproxynow.com.
4.9. MobileProxyNow may send system-related messages that contain important information about the dashboard or the provision of services. These include, for example, renewal reminders, payment confirmations, service interruptions, or updates to these Terms. Such messages are necessary for the operation of the platform and cannot be unsubscribed from.
5. ORDERING PROCESS
5.1. All orders for proxy services are placed through the MobileProxyNow dashboard. Customers select the desired plan or renewal option on the “Buy Proxies” page and then click “Proceed to Checkout.” The purchase is completed using the customer’s available account balance. If the balance is insufficient, the customer must first top up funds under “Add Funds” before proceeding.
5.2. During the checkout process, all relevant details of the selected proxy plan, such as duration, price, and key features are displayed for final review. By clicking “Confirm and Pay,” the customer submits a binding offer to conclude a contract for the selected service.
5.3. After successful payment, the ordered proxy service is automatically activated, unless manual setup is required. In such cases, activation is completed within a reasonable timeframe, typically within 24 hours. Activation marks the start of the contractual service period.
5.4. All completed orders and payments are permanently recorded under the “Billing” section of the dashboard. Each entry includes payment details, activation date, and service duration, serving as official proof of purchase.
5.5. MobileProxyNow reserves the right to reject or suspend orders in cases of suspected misuse, insufficient balance, inaccurate data, or violation of these Terms.
6. SERVICE LEVEL, MAINTENANCE
6.1. MobileProxyNow endeavors to provide its users with a service that is as uninterrupted as possible. MobileProxyNow guarantees the user an average availability of the service of 95% on a monthly average (hereinafter referred to as “guaranteed availability”). The relevant period for the calculation is the respective calendar month.
6.2. When calculating the actual availabilities, periods of downtime that are not attributable to MobileProxyNow are not considered service interruptions. Such periods include, in particular:
- 6.2.1. Unforeseen maintenance work or technical measures required to ensure system stability or security, provided such work was not caused by a breach of MobileProxyNow’s obligations (force majeure, hardware failures, power outages, strikes, natural events, etc.);
- 6.2.2. Downtime resulting from malware incidents or cyberattacks, if MobileProxyNow has implemented the usual and appropriate protective measures;
- 6.2.3. Downtime required for the application of urgent updates or security patches;
- 6.2.4. Interruptions caused by third parties, in particular disruptions of mobile data networks or other infrastructure operated by mobile carriers, data-center operators, or upstream network providers.
6.3. If MobileProxyNow falls short of the guaranteed availability within a given calendar month, the user shall be entitled to a partial refund of the service fee for that month, provided that the user was demonstrably affected by the interruption and can reasonably prove it. The partial refund shall be calculated according to the degree of deviation from the guaranteed availability as follows:
- 90 – 94.99% → 25% refund
- 80 – 89.99% → 50% refund
- 50 – 79.99% → 75% refund
- 00 – 49.99% → 100% refund
Refunds are issued either as credits to the user’s dashboard balance or, upon request, to the original payment method used for the transaction. Processing of refunds may take up to five business days after confirmation.
6.4. Scheduled maintenance work that may cause temporary service interruptions is usually performed during low-traffic hours and, whenever possible, announced in advance through the dashboard or by email. Such maintenance activities are part of regular system operation and do not entitle the user to compensation.
6.5. The user is obliged to notify MobileProxyNow immediately of any impairment or interruption of service availability. MobileProxyNow will endeavor to remedy verified impairments without undue delay. A claim for restoration of availability or for compensation does not exist insofar as the guaranteed availability specified in Section 6.1 is maintained.
7. SUPPORT
7.1. Each customer has access to the MobileProxyNow dashboard, which allows them to manage their proxies at any time. This includes functions such as configuration, credential management, renewals, and other available technical functions.
7.2. If customers require further assistance, they can contact MobileProxyNow via Telegram or by email at support@mobileproxynow.com. Current business hours can be obtained on Telegram by sending a message to the official support account.
7.3. Support requests must include accurate and complete information about the issue to enable quick and effective processing. MobileProxyNow strives to respond as promptly as possible, but no fixed response time can be guaranteed.
7.4. MobileProxyNow reserves the right to reject support requests that are inappropriate, repetitive, or unrelated to the operation of the provided services.
7.5. MobileProxyNow assumes no responsibility for any losses or damages resulting from delays or the absence of support responses, unless caused by its own fault or negligence.
8. OBLIGATIONS AND RIGHTS OF USERS
8.1. Users agree not to misuse the service provided by MobileProxyNow, including the proxies purchased from MobileProxyNow. In particular, they commit to refraining from any actions related to the use of the service that violate applicable law, infringe on the rights of third parties, or contravene accepted legal or ethical standards. Users explicitly assure that they will not commit any crimes through the use or support of the service.
8.2. Users may not use any programs, algorithms, or other software in connection with the use of the service that could impair its functionality. They must not take any measures that could lead to an unreasonable or excessive load on the service’s infrastructure or disrupt it. The sending of automated mass messages or mass emails to other users or customers is also prohibited.
8.3. Users commit to providing MobileProxyNow with truthful and complete information. Should the provided data change during the contract period, users must immediately update this information in their dashboard.
8.4. Users are responsible for all activities conducted through their account and agree to inform MobileProxyNow immediately of any unauthorized use of their account or other security breaches.
8.5. Users commit to not using the services of MobileProxyNow for any illegal activities, including but not limited to hacking, spamming, fraud, or accessing prohibited content. They are responsible for ensuring that their use of the service complies with all applicable laws and regulations and must not engage in any activities that could harm or disrupt the service, its users, or any third parties. MobileProxyNow reserves the right to suspend or terminate user accounts if a violation of these conditions is detected.
8.6. Furthermore, it is strictly prohibited to:
- bypass verification systems of third-party platforms (e.g., PayPal, Klarna, Stripe);
- create or manage fake accounts, multi-accounts, or referral fraud setups;
- access websites or services that explicitly restrict proxy usage (e.g., eBay, Kleinanzeigen, Vinted);
- use the service in a way that leads to IP blacklisting or abuse reports.
9. FREE TRIAL PERIOD
9.1. Users may request a one-time free trial of the service for a limited period of 60 minutes from activation. The trial provides access to the same technical functions as the paid version. To activate the trial, the user must contact MobileProxyNow via Telegram, email, or another official contact option.
9.2. Each user may use the free trial only once. Repeated use under different accounts or identities is strictly prohibited.
9.3. There is no legal entitlement to receive a free trial. MobileProxyNow reserves the right to deny or discontinue free trials at any time without prior notice or justification.
10. USAGE FEES, ACTIVATION, RENEWAL
10.1. A usage fee is charged for the use of the service, the amount of which depends on the selected usage period. The usage fee is to be paid by the user in advance.
10.2. The service shall be activated for the user immediately after MobileProxyNow has received or credited the usage fee for the selected usage period. However, in exceptional cases, activation may take up to 24 hours after receipt of the usage fee by MobileProxyNow.
10.3. At the end of the selected usage period, the user’s usage option is automatically withdrawn. However, the user has the option to extend the usage period at any time by placing a new order via the dashboard. If payment or credit is received before the end of the current usage period, the user may continue to use the service without interruption. Users are informed about upcoming expirations via email or Telegram shortly before their plan ends, depending on the selected duration.
11. PRICES, PAYMENT
11.1. All prices displayed within the MobileProxyNow dashboard are in US Dollars ($) and include statutory VAT where applicable. The prices shown at the time of purchase apply.
11.2. Before purchasing any services, users must first top up their account balance in the dashboard. Top-ups can be made using the following payment methods:
- Credit card (VISA, Mastercard via Stripe)
- Cryptocurrency (e.g., Bitcoin, Ethereum, USDT via Cryptomus)
11.3. Once the top-up payment has been successfully processed, the credited amount immediately becomes available as the user’s internal balance in US Dollars ($). Purchases of proxy services are made by deducting the corresponding amount from this balance.
11.4. Top-ups are non-refundable and cannot be withdrawn or transferred to another account once credited. Funds are intended exclusively for the purchase of services offered by MobileProxyNow.
11.5. Users are responsible for providing accurate and up-to-date payment details. MobileProxyNow is not liable for delays or issues resulting from incorrect or incomplete information.
11.6. If a top-up or purchase payment fails or is reversed, MobileProxyNow reserves the right not to activate the affected services or to suspend access until the payment has been successfully completed.
11.7. In the case of a valid refund (for example, under Section 6.3), cryptocurrency payments will be refunded exclusively in USDC (ETH ERC-20), regardless of the original cryptocurrency used. Refunds for credit-card payments are processed via Stripe. Refunds are normally completed within five business days; requests submitted on weekends are processed on the following business day.
12. CONTRACT PERIOD, TERMINATIONS
The contract period is determined by the plan selected and purchased by the user within the MobileProxyNow dashboard. Each plan has a defined usage period ranging between 1 and 365 calendar days. If access to the service has been obtained through an authorized reseller, the contract period is based on the usage quota purchased from that reseller. Ordinary termination during the contract term is excluded.
12.2. The right to extraordinary termination for good cause remains unaffected. A good cause entitling MobileProxyNow to extraordinary termination exists in particular if the user repeatedly violates any obligation arising from these Terms, especially in cases of illegal activities or breaches as outlined in Section 8.
12.3. In the event of extraordinary termination, the user must immediately cease using the service. MobileProxyNow reserves the right to block the user’s account and delete all stored data, provided that no statutory retention obligations apply.
12.4. Termination must be submitted in text form (e.g., by email) and becomes effective upon receipt by the recipient.
12.5. Upon expiration of the contract period, the user’s access to the service will automatically expire. Any fees paid in advance will not be refunded unless otherwise required by law or explicitly agreed. In cases of fraud, abuse, or violations of these Terms or the Fair Use Policy, no refunds will be granted—regardless of remaining usage time, payment method, or prior access.
13. DISCLAIMER / LIMITATION OF LIABILITY
13.1. MobileProxyNow shall be liable without limitation for intent and gross negligence. For simple negligence, MobileProxyNow shall only be liable for damages arising from injury to life, body, or health, as well as for damages resulting from the breach of an essential contractual obligation (obligation whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner regularly relies and may rely).
13.1.3. This also applies to the violation of provisions of the General Data Protection Regulation (GDPR).
13.2. In the event of a simple negligent breach of essential contractual obligations, the liability of MobileProxyNow is limited to the amount of the foreseeable, typically occurring damage.
13.3. Otherwise, the liability of MobileProxyNow is excluded.
13.4. The above limitations of liability shall also apply in favor of the legal representatives and vicarious agents of MobileProxyNow.
13.5. MobileProxyNow shall not be liable for lost profits, indirect damages, consequential damages, or claims by third parties.
13.6. The aforementioned limitations of liability also apply in favor of the legal representatives and agents of MobileProxyNow.
13.7. The limitations of liability do not apply insofar as MobileProxyNow has fraudulently concealed a defect or has assumed a guarantee. The same applies to claims by users under the Product Liability Act (ProdHaftG).
14. DATA PROTECTION AND UNENCRYPTED COMMUNICATION
14.1. MobileProxyNow processes personal data of users in accordance with the applicable data protection laws, in particular the General Data Protection Regulation (GDPR). Further information on how data is processed can be found in the Privacy Policy available at https://mobileproxynow.com/privacy.
14.2. Communication between MobileProxyNow and users is generally carried out digitally via the dashboard, email, or Telegram. Standard email communication may not be encrypted and therefore may offer limited confidentiality. By using these communication methods, users acknowledge and accept this form of contact.
14.3. Users have the right to request information about their personal data stored by MobileProxyNow, as well as to request correction, deletion, or restriction of processing, unless statutory retention obligations apply. Requests can be sent to support@mobileproxynow.com.
14.4. If users contact MobileProxyNow via Telegram, communication may involve automated responses provided by a chatbot powered by ChatGPT. By contacting us through Telegram, users consent to this communication method.
15. RIGHT OF WITHDRAWAL FOR DIGITAL SERVICES
15.1. Consumers generally have the right to withdraw from this contract within fourteen (14) days without giving any reason.
15.2. However, the right of withdrawal expires prematurely if MobileProxyNow has fully performed the service and has begun to perform the service only after the consumer has given their express consent and at the same time has confirmed their knowledge that they lose their right of withdrawal once performance of the service begins.
15.3. For digital services, such as access to the mobile proxy service, the consumer explicitly agrees by accepting these Terms that MobileProxyNow begins performing the service immediately after conclusion of the contract and that the right of withdrawal is therefore lost. The consumer is expressly informed of this during the order process and must confirm it by clicking the corresponding checkbox.
15.4. To exercise the right of withdrawal, the consumer must inform us (MobileProxyNow, represented by Niels van Veen, c/o Postflex #8764, Emsdettener Str. 10, 48268 Greven, Germany, Email: support@mobileproxynow.com).
15.5. To meet the withdrawal deadline, it is sufficient for the consumer to send the notification of exercising the right of withdrawal before the withdrawal period has expired.
15.6. If you wish to withdraw from the contract, you may either send us a clear statement of your decision to withdraw (e.g. by email or letter) or use the withdrawal form below. Using the form is not mandatory.

16. DISPUTE RESOLUTION
16.1. In the event of disputes related to the use of the platform or these Terms, users may first contact customer support. MobileProxyNow will strive to reach an amicable solution.
16.2. MobileProxyNow is not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
17. FINAL PROVISIONS
17.1. The contractual relationship between MobileProxyNow and the user is governed exclusively by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
17.2. If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or missing provision shall be replaced by the corresponding statutory provision. In place of the invalid or unenforceable clause, the valid provision that most closely reflects the economic intent of the original provision shall be deemed agreed. The same applies to any gaps in these Terms.
17.3. If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be the registered office of MobileProxyNow.
17.4. Amendments and supplements to these Terms must be made in text form. This also applies to any waiver of the text-form requirement itself.
18. FINAL REMARK ON LEGAL USE AND FRAUD PREVENTION
18.1. MobileProxyNow emphasizes that its services are provided strictly for lawful and legitimate purposes. Any misuse, including but not limited to illegal activities or fraud, is strictly prohibited and may result in the immediate termination of services without refund.
18.2. In cases of suspected illegal use, MobileProxyNow will cooperate fully with competent authorities and provide all necessary information upon lawful request.
18.3. Users and organizations are encouraged to report any suspicious behavior or misuse of the service directly to support@mobileproxynow.com.
18.4. Access to certain websites or services may be technically restricted to ensure compliance and prevent misuse. MobileProxyNow maintains global blocklists that may include, but are not limited to, platforms in categories such as banking, crypto, e-money, marketplaces, or government-related services. These restrictions apply automatically and uniformly to all users and cannot be disabled individually. The technical availability of a platform does not imply that its use is permitted. Attempting to use the service for activities that violate third-party policies or circumvent access restrictions is strictly prohibited and may result in immediate suspension without refund.
18.5. These measures are an integral part of MobileProxyNow’s commitment to maintaining legal, secure, and ethical operations.
